These Terms of Service (the “Terms”) govern your access to and use of our services, including: our various web pages, SMS, API, email notifications, applications, widgets, advertisements, merchant services, and Mobile Notifications (collectively referred to as the “Services”), as well as any information, text, link, graphic, photo, audio, video or material or arrangement of material uploaded or appearing on the Services (collectively referred to as the “Content”). By using these Services, you agree to be bound by these Terms.
You may only use the Services if you agree to enter into a binding contract with Trustable World and are not banned from using the Services in accordance with the laws of your applicable jurisdiction. In any case, you must be at least 18 years old to use the Services. If you accept these Terms and use the Services on behalf of a company, organisation, government or other legal entity, you represent and warrant that you are authorised to do so and have the necessary powers to ensure it to complies with these Terms, in which case the use of the words “you” and “your” in these Terms will refer to that legal entity.
Our Privacy Policy describes how we treat the information you provide to us when you use our Services. You understand that by using our Services, you consent to the collection and use (as set out in the Privacy Policy) of this information, including its transfer to the United States, Ireland and / or other countries, for its storage, processing and use by Trustable World and its subsidiaries.
You are responsible for your use of the Services and any Content you provide, including compliance with applicable laws, rules, and regulations. You should only provide us with content that you want to share with others.
The trust you place in any Content or material published via or obtained through the Services, and any use you make of them, is at your own risk and expense. We do not endorse, support, reaffirm, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communication posted through the Services, nor do we endorse any opinion expressed through the Services. You understand that by using the Services, you may be exposed to Content that may be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, to postings that may have been misinterpreted or may be misleading in some other way. All Content is the sole responsibility of the person producing it. We do not monitor or control the Content published via the Services, and we cannot be held responsible for such Content.
We reserve the right to remove content that violates the User Agreement, such as copyright or trademark violations or any other misuse of intellectual property, phishing, illegal conduct, or harassment.
If you believe that your Content has been copied in a way that constitutes an infringement of copyright, or does not comply with legal regulations, notify us by sending an e-mail to legal@workbai.com, providing as much information as possible in order to facilitate the location of the content, along with the reason for the claim.
You retain your rights regarding any content that you submit, post, or display through our Services. You are the owner of your Content (and the embedded audio, photos and videos that are considered part of the Content).
By submitting, posting or displaying Content via the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute said Content in each and every one of the possible means of communication or distribution methods, whether currently known or subsequently developed (for clarification, these rights include, for example, those of organisation, transformation and translation). This license authorises us to make your Content available to the rest of the world and to allow others to do the same. You agree that this license grants Trustable World the right to provide, promote and improve the Services, and to make content submitted to or through the Services available to other companies, organisations or individuals for syndication, broadcast, distribution, propagation, promotion or publication of such content on other media and services, subject to our terms and conditions for the use of such Content. Such further uses by Trustable World or other companies,
organisations or individuals will be effected with no payment to you of any compensation for Content that you have submitted, posted, transmitted, or otherwise made available to the public through the Services, as you agree that your use of the Services constitutes sufficient compensation for the Content and the assignment of rights contemplated herein.
Trustable World has an evolving set of rules to govern how fellow users can interact with the Content you post on the Services. These rules exist to enable an open environment that takes your rights into account. You understand that we may modify or adapt your Content when it is distributed, syndicated, published or broadcast by us or by our partners and / or that we may make changes to your content to adapt it to different media.
You represent and warrant that you hold, or have obtained, all the rights, licenses, consents, permissions, powers and / or authorisations necessary to grant the rights conferred here for any Content that you send, publish or display on or through the Services. You agree that such Content will not contain materials subject to copyright or other ownership rights, unless you have the necessary permission or are legally empowered to post such materials and to grant Trustable World the license described above.
Comply with the Trustable World Rules and Policies, which are part of the User Agreement and which outline the prohibitions regarding the Services. You may only use the Services if you comply with these Terms and with all applicable laws, rules and regulations.
Our Services are constantly evolving. As such, the Services may change from time to time, at our discretion. We may stop providing you or other users with the Services (permanently or temporarily) either globally or regarding any features thereof. We will also retain the right to set limits on use and storage at our sole discretion at any time. We may also remove or refuse to distribute any Content found on the Services, limit the distribution or visibility of any Content within the service, suspend or terminate users, and claim usernames with no liability towards you. Trustable World may offer some services or features in exchange for payment; by paying for or using one of these services, you agree to the additional conditions applicable to that service.
In consideration of Trustable World and the access and use that it grants you of its Services, you agree that Trustable World and its suppliers and partners may advertise on the Services or place advertising related to the content or information that you or others have submitted to the Services and which are displayed on it. You also agree not to misuse the Services, for example by interfering with them or accessing them using a method other than the interface and instructions that we have provided to you. You will not perform any of the following actions when accessing or making use of our Services: (i) access, sabotage or use of the non-public areas
areas of the Services, Trustable World computer systems or the technical systems of Trustable World suppliers; (ii) test, scan or verify the vulnerability of any system or network or violate or circumvent any security authentication measure; (iii) access or investigate or attempt to access or investigate the Services in any way (automatically or otherwise) other than through our interfaces, currently available, published and provided by Trustable World (and only as per the terms and applicable conditions), unless you have been specifically allowed to do so by a different agreement with Trustable World (NOTE: Tracking of the Services is allowed if done according to the provisions of the robots.txt file, however, “scraping” from the Services without the prior written consent of Trustable World is expressly prohibited); (iv) insert any TCP / IP header packets or any portion of the header information in any email or post, or use the Services in any way to send altered, erroneous, or false source identification information; or (v) interfere with, or hinder, (or attempt to do so), the access of any user, host or network, including, but not limited to, the sending of viruses, overloads, accumulations, spam, bombardment of emails from the Service, or inserting script in the creation of Content in such a way that it interferes or creates an undue burden on the Services; (vi) publish via the services information, images, or videos modified with a method other than the interface and instructions that we have provided; (Vii) modify the location of the published content which Trustable world obtains through the geolocation functionalities of your device. We also reserve the right to access, read, retain and disclose any information that we deem reasonably necessary in order to (i) comply with any applicable law, regulation, legal process or governmental request,
(ii) enforce the Terms, including the investigation of potential infractions of them, (iii) detect, prevent or solve in any way fraud, security or technical problems, or (iv) respond to requests for help from users, or (v) protect the rights, property, or safety of Trustable World, its users, and the public. Trustable World does not disclose personally identifiable information to third parties, except in the circumstances detailed in our Privacy Policy.
Your Account
You may need to create an account to use our Services. You are responsible for keeping your device and your account secure, so you must notify us immediately of any unauthorised use or breach of security in your account or services. We cannot and will not be held liable for any loss or damage resulting from fraudulent use of the services.
To access some services, it will be necessary to provide your phone number, with that number becoming your account; it is your responsibility to keep the number updated, and to delete the account if you stop using that number.
If you lose the telephone number associated with your account, you can request the deactivation of the account in question by sending an email to legal@workbai.com, including information that proves your ownership, for example an invoice.
You can control most communications on the Services. We may need to send you certain communications, such as service announcements and administrative messages. Such communications are considered part of the Services and you will not be able to opt out of receiving them on your account.
Trustable World grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided to you as part of the Services. This license is for the sole purpose of allowing you to use and enjoy the benefit of the Services provided by Trustable World, in the manner authorised in these Terms.
The Services are protected by copyright, trademark, and other laws in both the United States and other countries. Nothing in these Terms gives you the right to use the Trustable World name or any of the trademarks, logos, domain names, other distinguishing features of the brand, or any other intellectual property rights. All right, title and interest in and to the Services (excluding User Provided Content) is and will remain the exclusive property of Trustable World and its licensors. Any opinion, comment or suggestion you may provide regarding Trustable World or the Services is entirely voluntary and we are free to use such opinion, comment or suggestion as we see fit without any obligation to you.
You can cancel your legal agreement with Trustable World at any time by deactivating your accounts and discontinuing use of the Services.
We may suspend or terminate your account, or stop providing you with all or part of the Services, at any time and for any reason, or for no reason, for example if we reasonably believe: (i) that you have breached these terms (ii) that you represent a risk or potential legal liability; (iii) that your account should be deleted due to illegal conduct; or (iv) that your account should be deleted due to prolonged inactivity; or (v) that providing the Services to you is no longer commercially viable. In any case, the Terms will be cancelled, including, among others, your license to use the Services, except for the following sections that will continue to apply: 2, 3, 5 and 6. If you believe that your account has been terminated by mistake, you can send an email to legal@workbai.com. For clarification purposes, these Terms will remain in effect after the deactivation or termination of your account.
You agree that your access to and use of the Services or any Content will be at your own risk and expense. You understand and agree that the Services are provided to you “AS IS” and “SUBJECT TO AVAILABILITY”. “Trustable World Entities” means Trustable World, its parent companies, subsidiaries, related companies, officers, officers, employees, agents, representatives, partners, and licensees. Without limitation on the generality of the foregoing, to the maximum extent permitted by applicable law, TRUSTABLE WORLD ENTITIES EXCLUDE ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. The
Trustable World entities make no warranties or representations and exclude all liability regarding: (i) the completeness, accuracy, availability, timeliness, security or reliability of the Services or any Content; (ii) any damage to your computer system, loss of data or other damages resulting from your access or use of the Services or any Content; (iii) the elimination of any Content or other communications maintained by the Services or the impossibility of storing or transmitting such Content or communications; and
(iv) whether the Services will meet your requirements or be available in an uninterrupted, secure, or error-free way. The suggestions or information, whether verbal or written, obtained from Trustable World Entities or via the Services, will not create any guarantee or representation that has not been expressly listed in this document.
YOU AGREE THAT TO THE FULLEST EXTENT PERMITTED BY THE APPLICABLE LAW, TRUSTABLE WORLD ENTITIES SHALL NOT BE LIABLE FOR ANY TYPE OF INDIRECT, DERIVED, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSSES OF PROFITS OR INCOME REGARDLESS OF WHETHER SUCH LOSSES ARISE DIRECTLY OR INDIRECTLY, OR LOSSES OF DATA, USE, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING FROM: (i) YOUR ACCESS OR USE OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY THIRD PARTY BEHAVIOUR OR CONTENT ON THE SERVICES INCLUDING, WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT BY OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICES; OR (iv) UNAUTHORISED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. UNDER NO CIRCUMSTANCES SHALL THE TOTAL LIABILITY OF TRUSTABLE WORLD’S ENTITIES EXCEED THE AMOUNT OF TWENTY EUROS (20.00 EUROS) OR THE AMOUNT THAT YOU HAVE PAID TO Trustable World, IF ANY, IN THE LAST SIX MONTHS FOR THE SERVICES THAT HAVE GIVEN RISE TO THE CLAIM, SHOULD THIS LATTER BE GREATER. THE LIMITATIONS CONTAINED IN THIS SUBSECTION SHALL APPLY TO ANY PRINCIPLE OF LIABILITY, REGARDLESS OF WHETHER IT IS BASED ON ANY WARRANTY, CONTRACT, LAW, EXTRA-CONTRACTUAL LIABILITY (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL CONCEPT, AND WHETHER OR NOT Trustable World entities
HAVE BEEN INFORMED OF THE POSSIBILITY OF INCURRING SUCH DAMAGES, EVEN IN THE EVENT THAT THE LEGAL ACTIONS SET FORTH HEREIN DO NOT HAVE THE INTENDED EFFECTS.
We may revise these Terms from time to time. Changes will not be retroactive and the latest version of the Terms, which can always be found at https://trustable.world, will govern our relationship with you. Apart from changes related to new functions or that are made for legal reasons, we will inform you of any change that come into effect with respect to these Terms and that affects the rights or obligations of any of the parties in these Terms upon accessing the services. By continuing to access or use the Services after such changes become effective, you agree to be bound by the revised Terms.
Any disputes relating to these Terms or the Services will be brought only before the courts of Madrid, Spain, and you accept personal jurisdiction and waive any objection to inconvenient forum.
In the event that any provision of these Terms is deemed invalid or cannot take effect, then you cannot use the services, and you must terminate your account immediately; in the event of dispute, said provision will be limited or eliminated in the least disruptive manner, and the remaining provisions of these Terms will remain valid and will maintain their full effect. The failure of Trustable World to enforce any of the rights or provisions of these Terms will not be deemed an omission of such right or provision.
